The article aimed to determine the relationship between neuroscience and emotional states in university faculty members from Latin America during the post-pandemic stage of COVID-19. It highlights the importance of understanding emotions from a neuroscientific perspective to develop strategies that enhance emotional management and resilience in the educational context. The descriptive-correlational research included a sample of 318 faculty members from various Latin American countries. The results revealed severe levels of stress (88.4%) and anxiety (92.1%), as well as inadequate (40.9%) or (...) moderate (46.9%) levels of resilience among the faculty members. A strong positive correlation was found between neuroscience and emotional states (rho=0.860), as well as a good positive correlation between neuroscience and resilience (rho=0.739). The study concludes that the knowledge and application of neuroscience principles could contribute to lower levels of stress and anxiety and increase resilience in university faculty members, emphasizing the importance of integrating these disciplines into the understanding and management of emotions in the educational field. Introduction: This study explores how learning experiences at public universities impact the development of critical thinking in early education students in 2023. Objective: To determine the influence of learning experiences on the critical thinking of early education students, identifying effective didactic strategies for its promotion. Methodology: Utilizing a quantitative approach, data were collected from 247 early education students across various public universities in Peru through structured surveys. These surveys were designed to measure students' perceptions of their learning experiences and their (...) impact on critical thinking, including items related to communicative, reflective, and problem-solving competencies. The instruments' validation was ensured through reliability and validity analysis, and data were statistically analyzed using SPSS V.25 software to examine the relationships between variables. Results: The findings indicated a positive and significant correlation between carefully designed learning experiences and the enhancement of students' critical thinking. This link underscores the critical value of adopting didactic strategies focused on fostering critical thinking, showing that when students are immersed in learning environments that challenge their abilities and promote reflection, their capacity to analyze, synthesize, and evaluate information significantly improves. Conclusions: The findings highlight the necessity for universities to continuously implement and adapt their pedagogical methods to foster meaningful and critical learning. This research contributes to understanding how educational experiences can be designed to enhance critical thinking, providing a foundation for future curricular and pedagogical developments in higher education. Astrology, its legitimacy, and the limits of its acceptable practice were debated in sixteenth- and seventeenth-century Europe. Many of the related arguments were mediated by the work of Giovanni Pico della Mirandola and the responses to it. Acknowledging the complexities of the relationship between astrological ideas and Christian teachings, this paper focuses on the Catholic debates by specifically considering the decisions about astrology taken by the Spanish Inquisition. The trials of astrologers are examined with the aim of understanding the role (...) of experts in astrology in early modern Spain. This study brings into view the specific nature of the debate on astrology in Spain, the consequences of the actions of the Inquisition and the social control it exerted. The historical events discussed comprise a particular case and also mirror the general debates about astrology taking place in early modern Europe. The experts’ opinions expressed in trials and in reports about the discipline received by the Inquisition reveal two key traits of the debate: the dispute about who had the authority to decide on the legitimacy of astrology and the disagreement about what constituted natural and judicial astrological practices. These led to different opinions about what was to be done with each defendant and about what content in their books ought to be forbidden. (shrink)

We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. Analysis of the phenomenon known as racketeering or "bandidismo" framed in a socio-historic context. According to the Real Decree of 1879, that included al1 individuals that committed some breach, including the independent ones. This involved delinquent. thieves, "es-presidiarios", independentists, revolutionary, and the traditional bandits. Here it is analyzed the construction ofthe myth, the summit since 1889, and the reasons why population supported them. En este trabajo analizo la autonomía y relevancia normativa de las normas permisivas. En especial, mis propósitos principales son revisar dos tesis escépticas: los permisos y las normas permisivas pueden reducirse a otras formas normativas, e.g. derogación de prohibiciones, y no se producen diferencias significativas cuando se permite una conducta que no había sido previamente regulada. Ambas tesis son examinadas en relación a la naturaleza y función del principio de clausura normativa. La conclusión de este trabajo es que las normas (...) permisivas, y en particular las normas de clausura, pueden cumplir una importante función en los sistemas normativos y son una herramienta útil para analizar otros problemas como las lagunas del derecho y la discreción judicial. According to robust versions of virtue epistemology, the reason why knowledge is incompatible with certain kinds of luck is that justified true beliefs must be achieved by the agent . In a recent set of papers, Pritchard has challenged these sorts of views, advancing different arguments against them. I confront one of them here, which is constructed upon scenarios affected by environmental luck, such as the fake barn cases. My objection to Pritchard differs from those offered until now by Carter (...) , Jarvis or Littlejohn in that it is based on the claim that cognitive performances may not be properly considered as achievements beyond the scope of the agent’s intentional action—an idea that confers more explanatory power on my argument, and contributes to stregthening links between knowledge and agency. Este trabajo analiza el lenguaje subjetivo empleado por el intelectual y político andalusí Lisān al-Dīn Ibn al-Ḫaṭīb (m. 1375) en su obra de exilio Nufāḍat al-ǧirāb. El objetivo es explorar la utilidad de un enfoque lingüístico en la comprensión del lugar que ocupa este texto dentro del proceso de transición cultural del Occidente islámico hacia el paradigma moderno europeo. El estudio se divide en tres partes: en la primera, se hace una breve introducción al autor, a su contexto socio-político y (...) al contenido de la obra; en la segunda, se plantea una metodología cuantitativo-cualitativa a través de la cual se estructura el texto misceláneo digitalizado en función de sus géneros y se especifica un esquema de anotación que permite extraer las instancias de los fenómenos lingüísticos más destacados; y en la tercera, se procede al análisis de los datos obtenidos en torno a la acción, la emoción y la evaluación. El análisis muestra una compleja codificación de la subjetividad en la Nufāḍa donde, a diferencia del Taʿrīf de Ibn Ḫaldūn, las marcas de expresión en primera persona, aunque significativas, son escasas. Sin embargo, se identifica un abundante uso de adjetivos evaluativos a lo largo de la obra, con una riqueza léxica que permite revelar de forma explícita el punto de vista del sujeto autor. Este hallazgo demuestra la utilidad de una metodología híbrida en la aproximación a textos histórico-literarios premodernos, así como la necesidad de incorporar el análisis lingüístico, empírico y comparativo al estudio de la transición epistemológica señalada. In this paper, I consider some problems concerning the structure of legal systems. In order to do this, I basically analyze the promulgation and derogation of legal rules. Frequently, promulgation has been referred to as the introduction of a rule into, and derogation as the removal of a rule from, a normative system. I try to show that there is more to it than that. One of the main ideas of the paper is that the enactment or derogation of a (...) legal rule by an authority na restricts the competence of all lower authorities: Once a rule R has been enacted by an authority na, authorities inferior to na cannot remove R from the normative system; and when R has been derogated by na, lower authorities do not have the competence to introduce R into the system. Further important questions include: What happens with derogated rules? What is the structure of the set of derogated rules? When does a rule belong to a derogated set, and when is it removed from a derogated set? These questions are very important for a theory of legal systems, and I try to give some possible answers. Perhaps the main conclusion of the paper is that promulgation and derogation can be considered very similar processes with respect to legal systems. (shrink)

This paper critically addresses the logics of exceptionality inherent to emerging regulations of the gender field, with a focus on Spain’s recent self-determination-based regulation of gender. To achieve this, it offers a biopolitical analysis of the concept of “public order” and its influence on gender governance, drawing parallels to Agamben’s concept of the state of exception and exploring the connections between contemporary regulations and the gendered public order of nineteenth-century France. Finally, it analyzes the exclusions and restrictions that the Spanish (...) trans law reserves for migrants, non-binary people, and minors, contributing to the ongoing discourse on the limitations to gender autonomy in contemporary Western societies. The aim of this paper is to discuss a basic assumption tacitly shared by many philosophers of mind and language: that whatever can be meant, can be said. It specifically targets John Searle’s account of this idea, focussing on his Principle of Expressibility (PE henceforth). In the first part of the paper, PE is exposed underlining its analyticity (1) and its relevance for the philosophy of language (2), mind (3), society and action (4). In the critical part, the notion of (...) Background is taken into account in order to re-evaluate two basic distinctions: the one between sentence and utterance meanings (5), and the one between native and type speakers (6). PE is reconsidered in the light of the previous arguments as a methodological strategy that does not prevent uses of language from eventual semantic excesses and deficits (7), and a complementary Principle of Expression Fallibility is finally proposed (8). Para las tradiciones escolásticas budistas, el universo es inseparable de la vida mental de los seres que lo habitan, siendo las acciones de los seres, con sus estados mentales asociados, las que trazan el mapa y calendario cósmico. Algunos investigadores han visto en estas asociaciones entre mente y universo la «contraparte imaginativa, mítica y poética de los estados meditativos». Este artículo intenta mostrar cómo la propia escolástica mantiene cierta ambigüedad sobre si el cosmos debe entenderse como una metáfora de la (...) mente o debe identificarse literalmente con ella. Algunos pasajes establecen una complementariedad que parece afirmar la existencia independiente de ambos. Sea como fuere, contrastar las descripciones de estados mentales con relatos cosmogónicos nos permitirá comprender mejor la idea del cosmos en el budismo antiguo. (shrink)

Com base no método de investigação histórica a partir de pesquisa bibliográfica e documental e tendo por fontes, leis, decretos e dados estatísticos, o artigo foi dividido em duas partes: A primeira, dedicada aos irresolutos percursos da Educação pública do Brasil, depois de sua anunciada (...) Independência política do Reino Português. Na sequência, discorre sobre o longo trajeto de conquista da universalização do ensino fundamental no século XX. Resumen La ética es un saber filosófico que puede ser enfocado de distintas maneras, y una de ellas es el enfoque de la vulnerabilidad, que es un aspecto evidente de la realidad humana. Desde este punto de vista, es preciso distinguir entre la vulnerabilidad general y la vulnerabilidad contextual. Por su parte, en el caso de la vulnerabilidad contextual, es necesario distinguir entre la que es producto de opciones voluntarias y la que se produce por razones involuntarias. En el marco (...) de estas distinciones, reflexionamos sobre la situación de pandemia mun dial que estamos padeciendo y proponemos algunas medidas de carácter ético que pueden ser útiles para afrontar la crisis.Ethics is a philosophical knowledge that can be approached in different ways, and one of them is the approach to vulnerability, which is an evident aspect of human reality. From this point of view, it is necessary to distinguish between general vulnerability and contextual vulnerability. In the case of contextual vulnerability, it is necessary to distinguish between that which is the product of voluntary choices and that which occurs for involuntary reasons. Within the framework of these distinctions, we reflect on the global pandemic situation that we are suffering from and propose some ethical measures that may be useful in facing the crisis. (shrink)

The aim of this paper is to defend moral relativism from the accusation that it would make it irrational to classify past changes in public opinion as instances of moral progress, for they would constitute an improvement only from our current point of view. The argument is this. For our assessment of a change in public opinion as an instance of moral progress to be rational, we need to take the moral claims made before the change to be false simpliciter (...) while being open to the possibility that we ourselves change our minds at some point. These two things can be made compatible if we construe moral relativism as taking the truth of moral claims to be relative to the context of assessment. Thus understood, moral relativism is in fact the only view that makes room for talk of moral progress, as the rest of candidate positions make it irrational. (shrink)
